SeaZone Data Licensing Policy
SeaZone data is protected by British Crown Copyright and other copyright and supplied under the terms and conditions stated in SeaZone's Digital Data Licence Agreement and Electronic Publishing Agreement.
These Licenses, which are non-exclusive and non-transferable, set out, among other things, the copyright and other intellectual property rights (IPR), and the permitted non-navigational usage of the data by the Licensee, as well as a number of restrictions.
The terms and conditions of the SeaZone data licences are determined by SeaZone's own agreements with the United Kingdom Hydrographic Office (UKHO) and other data collaborators.
Digital Data Licence
Allows for the use of SeaZone data for internal business use only for the period and number of users defined in the Licence.
The standard licence prohibits the use of the data by any third parties including the use by the Licensees contractors. This restriction extends to any data that has been derived from the licensed data. Derived data is subject to the same terms and conditions as the data from which it was derived.
Please contact SeaZone Customer Services for further clarification and consent for additional use terms.
Two types of users are defined within the standard Digital Data Licence. Each user type is specified separately in the licence but each licence may contain any number of both local and remote users:
- Local Users are users that access the data directly using desktop GIS or similar software. The data may be stored on the user's PC or on a central server.
- Remote Users are users that access the data via a webGIS or similar service operating on an Intranet or the Internet where access to the site is available to authorised users only. The data is stored on a central server.
Use of the data must not exceed the type and number of users specified in the Digital Data Licence.
Electronic Publishing Licence
SeaZone's Electronic Publishing Licence allows the use of SeaZone data on a public Internet website, with two options available for delivery as detailed below:
- Publication of Static Images A static image is a non-editable graphical representation of the Data where it is being published as a background to display information specific to the licensees activities.
- WebGIS, Internet Mapping or similar service The licensed data is contained on a server which renders a raster image of the data according to the requests submitted to the server by the user.
Period of Licence
SeaZone Licenses are issued as standard for a one year period or for a period of up to three years, on request. On expiry of the licence period, the licence must be renewed or the licensee must stop using the data and delete the data from his systems, returning all original media to SeaZone Solutions Limited. Continued use of the data by the licensee without the licence renewal will constitute breach of copyright and may result in prosecution.
Policy Changes
SeaZone reserves the right to update, introduce and withdraw products, software and services at any time and to change its pricing and licensing conditions. SeaZone notifies existing licenses and software users with a current support contract of all pricing and policy changes directly, and through other media including the SeaZone website.
